PFS uses an interdisciplinary approach to represent clients in restructuring, workout, foreclosure and litigation matters involving distressed or nonperforming commercial and real estate loans. The attorneys in our Finance and Real Estate Practice Groups have significant experience in commercial and real estate financing transactions and, together with seasoned attorneys from our Litigation Practice Group, work with clients to reach negotiated resolutions of troubled credit situations where possible and in litigation if necessary.

In particular, our team has experience advising and assisting lenders to maximize their recovery of troubled loans while minimizing risk exposure and expense.

We have represented clients in a variety of matters involving distressed credit situations, including:

•  commercial and real estate loan restructuring and workouts;

•  public and private UCC sales;

•  judicial foreclosures;

•	relief from the automatic stay and avoidance actions in bankruptcy litigation;

•   fraudulent conveyance litigation;

•   guarantee litigation;

•   lien priority litigation; and

•   intercreditor issues.
